1st DWI: What to expect, penalties and defense strategy

What to expect - what happens when you get a DWI in Austin, TX
- DWI cases usually last between 6 months to a year, requiring multiple court appearances. 
- Your license will likely be revoked or suspended. 
​- A DWI is given to someone driving a car with a Blood Alcohol Content (BAC) of .08% or more. If your BAC was greater than .15%, you will likely receive an ignition interlock device in your car (a breathalyzer installed in your car that you must breathe into before the car will start). If you breathe anything above a 0, the car will not start. It is also equipped with a camera to ensure that you (the driver) are the one breathing into the device. 
1st Offense DWI Penalties:
- If your BAC was less than .15%, this will be a Class B misdemeanor if you are convicted.  
- If your BAC was greater than .15%, this will be a Class A misdemeanor if you are convicted. 
- If convicted, you will likely pay fines from $2,000 to $4,000. 
- Your license will likely be suspended for 90 days to 12 months. 
- You may be required to spend 72 hours to 6 months in jail (or up to one year in jail if BAC was more than .15%).
- You can opt or may be required to have an ignition interlock device installed in your car, which will remain in your car for the duration of your case. 
- You may be required to take and complete a DWI education program and do community service.
- You may be sentenced to probation if convicted.
