- This is a 3rd-degree felony charge in Austin, TX if you are convicted.
- If you are given probation, you will still be required to spend 10 days in jail. 
- You will be required to get an ignition interlock device installed in your car - you will not be able to drive without one. 
- You will be ordered to use either a Portable Alcohol Monitoring (PAM) system or SCRAM device. These devices are portable breathalyzers that are GPS-enabled and have face recognition. You will be required to blow into these devices several times a day, with the data from your blows being monitored by the court. 
- The court will order you to stop using alcohol and drugs without a prescription and you will likely be randomly drug tested to ensure cooperation. 
- You may be banned entirely from driving while your case is pending, a process that can take more than a year. 
Felony DWI Punishments:
- If convicted, you will be fined up to $10,000
- You will be required to serve between 2 to 10 years in The Texas Department Of Criminal Justice
- Your driver's license will be suspended for 180 days to 2 years.
- You will be required to pay a $1,500-$2,000 fee every year for 3 years in order to retain your driver's license
- You will be disqualified from voting and possessing a firearm (gun).
